Purpose and scope of application

The purpose of these General Contract Conditions is to regulate the relationship between Viladellops Vinicola S.L. (hereinafter “Finca Viladellops” and/or the Company) and you (hereinafter, the “Customer”), regarding all transactions carried out through of the Viladellops.com website (hereinafter, the “Website”) consisting of reservations for company visits and activities (hereinafter, the “Services”).

Exclusions

It is prohibited to provide Services through the Website to minors under the age of 18 who are not accompanied by an adult.

Likewise, the services offered by Finca Viladellops through the Website that involve the consumption of alcoholic beverages of any strength are prohibited to persons under 18 years of age.

Acceptance and proof of acceptance

The contracting of the Services offered by Finca Viladellops must be done through the RESERVE button that appears at the foot of the reservation page of the Services, and expresses full acceptance of the present general Contract Conditions prior to reservation of the Services, without applying the novelties that may occur in the clauses of the General Contracting Conditions subsequently.

From the moment of acceptance, the user acquires the status of Customer of Finca Viladellops as described in these General Conditions of Contract. Any service offered subsequently by Finca Viladellops must be subject to a new contract.

If the Customer wishes to read the General Conditions of Contract more carefully, they can print it on paper or save the document in electronic format.

Finca Viladellops will send the Customer, once the General Conditions of the Contract have been expressly accepted, proof of the contract, in all its terms, by email or certified mail with acknowledgment of receipt before 24 hours have passed since the purchase.

Likewise, Finca Viladellops will forward the reservation to the Customer through the electronic means provided by the Customer themselves.

Finca Viladellops informs you that it files the electronic documents in which the contracts are formalized, which the Customer can access at any time, by requesting it from the Finca Viladellops Visitor Service Department.
In the event that the Customer makes a mistake when sending the data, they can modify it at the Visits Department of Finca Viladellops.

Prices, Method of Payment, Conditions of visit and Cancellation of Reservation

4.1 Prices

The prices applicable to each Service are those indicated on the Website on the date of contracting, all of them including VAT.
Offers shall be duly marked and identified as such, conveniently indicating the previous price and the price of the offer.
Finca Viladellops reserves the right to make changes to the Website, at any time and without prior notice, making the modifications it deems appropriate, and to be able to update the Services daily depending on the market.

4.2 Form of payment

The acquisition of the Services can be done by any of the following means, namely:

• Through the “Banc de Sabadell” payment gateway.
• PayPal

4.3 Conditions of the visit

The visit will begin promptly at the specified time. After 10 minutes from the start time, it will no longer be possible to join the group.
Visits must be booked in advance given their limited capacity. If you show up without a reservation, you can join one of the visits if there are vacancies.

4.4 Cancellation of Reservation

Finca Viladellops offers the Customer the possibility to cancel their reservation through the email address info@viladellops.com. In case of cancellation of the visit, the amount charged will not be returned.

However, the Customer may make the visit on a different day to be agreed upon with the winery and within a maximum period of 2 months.
Finca Viladellops reserves the right to unilaterally modify the content, itinerary, alter the duration of the visit for justifiable reasons, such as rain, fog or other weather conditions, lack of electricity supply, mechanical or IT failures, etc.

In the event that Finca Viladellops cancels the visit before it begins, for reasons attributable to the company, you will have the right to reimbursement of the amounts paid.

Language

The language in which the contract between Finca Viladellops and the Catalan Customer will be finalized.

Responsibilities of Finca Viladellops

Finca Viladellops guarantees the quality of the Service contracted through its Website. All the rights that the Laws in force guarantee to consumers and users are guaranteed.

Failure to comply with any of these General Conditions of Contract may result in the cancellation of the Services contracted by the Customer.

Responsibilities of the Customer

The Customer undertakes to make lawful use of the Services, without contravening current legislation, or injuring the rights and interests of third parties.

The Customer guarantees the veracity and accuracy of the data provided when filling out the contract forms, avoiding the causation of damages to Finca Viladellops as a result of their inaccuracy.

Failure to comply with any of these General Conditions of Contract may lead to the withdrawal or cancellation of the Services by Finca Viladellops without the need for prior notice to the Customer and without this entitling them any type of compensation.

Personal data and commercial communications

Without prejudice to what is indicated in each of the forms on the Website, the personal data provided by the Customer will form part of a file owned by Finca Viladellops for the purpose of managing and responding to your request, as per to be able to send information about the products we manufacture and distribute, both by postal and electronic means.

Industrial and Intellectual Property

The intellectual and industrial property rights on the creations, brands, logos, and any other subject to protection, contained on the Finca Viladellops Website belong exclusively to Finca Viladellops or to third parties who have authorized their inclusion on the Website. The unauthorized reproduction, distribution, commercialization or transformation of said creations, brands, logos, etc. constitutes an infringement of the intellectual and industrial property rights of Finca Viladellops or of the holder thereof, and may give rise to the exercise of any judicial or extrajudicial actions that may correspond to the exercise of their rights.

Likewise, the information that the Customer can access through the Website may be protected by intellectual property rights or those of another nature. Finca Viladellops will not be responsible in any case and under any circumstances for the infringements of such rights that may be committed as a user.

Jurisdiction and Applicable Law

In the event that any conflict or discrepancy arises in the interpretation or application of these General Conditions of Contract, the Courts and Tribunals that, in their case, will hear about the matter, will be those that have the applicable legal regulations in the matter of competent jurisdiction, in which it serves, in the case of final consumers, the place of fulfillment of the obligation or the place of residence of the purchasing party.

In the case of a sale made by a company, both parties submit, with express waiver of any other jurisdiction, to the Courts and Tribunals of Barcelona (Spain).
